Koch Foods raid criminal cases refiled in municipal court

20 of 161 illegal immigrants arrested charged with violating state identity theft, forgery laws.

FAIRFIELD - Twenty of 161 people arrested earlier this week in an Immigration and Customs Enforcement raid were not arraigned as scheduled Thursday on state charges because the cases were moved from a county court.

The cases of the 12 men and eight women facing charges of forgery and taking the identity of another have been refiled in Fairfield Municipal Court, said Butler County Prosecutor Robin Piper.

The 20 charged may be arraigned Tuesday morning, according to a Fairfield court official. However, Piper said his office many present the cases to a grand jury for consideration.

ICE agents transported the 161 alleged illegal immigrants arrested in the Tuesday raid at Koch Foods in Fairfield to West Chester Twp., which is were Butler County Sheriff's deputies first came into contact with the 20 workers also suspected of committing state criminal offenses.

"They made a conscious decision to file charges in (Butler County) Area III Court because our first contact with these people was in West Chester," said sheriff's Chief Deputy Anthony Dwyer.

Detectives later determined much of the evidence was being collected through Fairfield tax documents and decided Fairfield Municipal Court was the appropriate venue.

"It is not unusual to have multiple possible locations for prosecution," Dwyer said.

ICE spokesman Greg Palmore said the 20 people facing criminal charges would go through the state court system before deportation proceedings.
